Terms of service
These Terms of Service (“Terms”) are an agreement between you and JK Systems LLC (“we,” “us,” or “our”) about your use of Blitzcribe, including the website at https://blitzcribe.com, the web application, and the Blitzcribe mobile apps (together, the “Services”). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Our Privacy policy explains how we handle personal information. Our Refund policy is part of these Terms.
1. Who can use Blitzcribe
You must be at least 13 years old to use the Services, and at least 18 (or the age of majority where you live) to buy a subscription. If you use the Services for an employer or another organization, you confirm that you are allowed to accept these Terms on its behalf.
Paid plans are offered in the United States. Prices are in US dollars.
2. Your account
You need an account to use the application. Keep your sign-in details secure and tell us at support@blitzcribe.com if you believe someone else has used your account. You are responsible for activity under your account.
You can delete your account at any time from your account settings. What happens to your data and any subscription when you do is described in section 7 and in our Privacy policy.
3. Your content
You keep ownership of the audio you record or upload, the transcripts generated from it, and the edits, speaker names, and other material you add (“Your Content”).
You give us permission to store, copy, process, and display Your Content to provide the Services to you, including sending audio to our transcription provider and keeping backups. We also use session replay for troubleshooting and product improvement, which may include content displayed in the website and apps, as described in our Privacy policy.
Blitzcribe does not use your data to train models, and we do not sell Your Content. Our transcription provider handles content under its applicable agreements and policies, as described in our Privacy policy.
You are responsible for having the rights and any consents required to record, upload, transcribe, and share Your Content, including consent from the people you record where the law requires it. Blitzcribe does not obtain consent on your behalf.
4. Acceptable use
Do not use the Services to:
- break the law, including recording or wiretapping laws that apply to you;
- infringe anyone’s intellectual property, privacy, or other rights;
- upload malware or interfere with the Services or other users;
- probe, scan, or test the Services’ security without our written permission;
- resell, sublicense, or share access to an account; or
- get around usage limits, for example by creating multiple Free accounts.
We may suspend or close an account that breaks these rules, after notice where that is reasonable.
5. Plans
Free. A Free account includes 3 hours of transcription in total. The allowance does not renew, and deleting a recording does not return any of it. Every completed transcription counts toward it, including transcriptions made while you had Pro.
Pro. Pro includes 20 hours of transcription per billing period and renews monthly until you cancel. The allowance resets on your monthly billing date. Once you use those hours, new transcriptions pause until the next period begins. While Pro is active, the free allowance does not limit you. Contact support@blitzcribe.com if you need more hours.
Team. Team plans are arranged by agreement. Contact us to discuss one.
Complimentary access. We may give some accounts Pro at no charge, for example Founders Circle members. Complimentary Pro lasts for the term we tell you when we give it.
Everything you have transcribed stays readable, editable, and exportable on every plan, including after a subscription ends.
We may change plans or what they include. If a change reduces what a paid plan includes, we will tell you before it takes effect.
6. Billing
Price. Pro costs $11.99 a month, plus any applicable sales tax. The same price applies on the web, in the App Store, and on Google Play. We will give you at least 30 days’ notice of a price change, and the new price will apply from your next renewal after the notice period. You can cancel before then.
Web purchases. Subscriptions bought on the web are processed by Stripe. By subscribing, you authorize us, through Stripe, to charge your payment method each month until you cancel. We do not receive or store your full card number.
App purchases. Subscriptions bought in the App Store or on Google Play are sold and billed by Apple or Google under their terms. Manage, cancel, or request a refund for those subscriptions through Apple or Google.
Discount codes. Discount codes can be redeemed only at web checkout. A code’s terms, including how long the discount lasts, are shown when you apply it. Codes have no cash value.
Failed payments. If a renewal payment fails, the billing provider may retry it. Pro stays active during any applicable grace period. Without a grace period, or when that period ends, the subscription no longer provides Pro access even if payment retries continue. Your account returns to the Free plan unless another active subscription or grant provides Pro. A successful later payment can restore access.
7. Cancellation and account deletion
You can cancel Pro at any time: on the web from Plan in your account settings (Manage subscription), or through Apple or Google for app subscriptions. That subscription provides Pro until the end of the period you have paid for. Your account then returns to the Free plan unless another active subscription or grant provides Pro. Refunds are covered by our Refund policy.
Deleting your account ends your access immediately and cancels a web subscription. We do not prorate unused subscription time or offer a refund for account deletion, except as required by applicable law. Deleting your account does not cancel a subscription bought through Apple or Google; cancel it with Apple or Google first. Export any transcripts you want to keep before deleting your account.
We may suspend or end your access if you materially breach these Terms, if required by law, or if we stop offering the Services. If we stop offering the Services for reasons other than your breach, we will give reasonable notice where we can, so you can export your transcripts before access ends. Our Refund policy applies, including any refunds required by applicable law.
8. The Services
Blitzcribe produces transcripts automatically. Transcripts can contain errors, including wrong words and wrong speaker labels. Check anything you intend to publish or rely on against the original recording.
We work to keep the Services available, but they may be interrupted for maintenance, by providers we rely on, or for reasons outside our control.
9. Disclaimers
To the extent the law allows, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim arose and US$50.
Some jurisdictions do not allow these limits, so they may not fully apply to you.
11. Indemnity
If you use the Services in breach of these Terms or the law, including by recording people without required consent, you agree to cover reasonable costs and losses we incur from third-party claims arising from that use.
12. App Store and Google Play
If you downloaded a Blitzcribe app from the Apple App Store, these Terms are between you and JK Systems LLC only, not Apple. We, not Apple, are solely responsible for the app and its content. You may use the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Apple has no obligation to provide maintenance or support for the app.
If the app fails to conform to any warranty that has not been effectively disclaimed, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws. We, not Apple, are responsible for investigating, defending, settling, and discharging any claim that the app or your use of it infringes a third party’s intellectual property rights.
You confirm that you are not located in a country subject to a US government embargo or designated by the US government as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties. You must also comply with any third-party terms that apply when you use the app, such as your wireless data service agreement.
Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple has the right to enforce these Terms against you as a third-party beneficiary.
If you downloaded a Blitzcribe app from Google Play, Google Play’s terms also apply to your download and to purchases made through Google Play.
13. Changes to these Terms
We may update these Terms. If a change is material, we will notify you by email or in the Services before it takes effect. Continuing to use the Services after a change takes effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Santa Clara County, California, unless the law where you live gives you the right to bring a claim locally.
15. General
These Terms, together with the policies they refer to, are the entire agreement between you and us about the Services. If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a part of these Terms, we have not waived our right to enforce it later. You may not transfer these Terms or your account without our written consent. We may transfer these Terms as part of a merger, acquisition, or sale of assets, and the Terms continue to apply.
